Sweepstakes Casino Crackdown: 17+ States Restrict the Model in 2026 - Source Code Lab

State Crackdown on Sweepstakes Casinos Escalates: Six Operators Shut, 17+ States Restrict the Model

The regulatory model that let sweepstakes casinos offer casino-style games nationwide without a traditional gambling license is collapsing state by state. At least 17 states have banned or restricted sweepstakes-style gaming in 2026, and six operators have permanently shut down since October 2025, according to industry tracking of state enforcement actions through mid-year.

Sweepstakes casinos run on a dual-currency model: players buy packages of virtual “gold coins” for entertainment play and receive bonus “sweeps coins” that can be redeemed for cash prizes, a structure operators have long argued falls outside traditional gambling law because no purchase is required to play for sweeps coins. States are increasingly rejecting that distinction outright.

Why regulators are moving now

The sweepstakes casino sector has grown to an estimated $10 billion in annual revenue, a scale that has made it impossible for state gaming and consumer-protection regulators to keep treating it as a gray-area novelty. Attorneys general in multiple states have argued publicly that the “no purchase necessary” sweepstakes carve-out was designed for promotional contests, not for platforms offering hundreds of slot-style games funded by real purchases. That gap between the legal exemption’s original intent and its current use is the core argument driving the wave of 2026 legislation.

California and Illinois lead the two enforcement tracks

California Governor Gavin Newsom signed AB 831 into law on October 11, 2025, making sweepstakes casinos illegal in the state effective January 1, 2026, a straightforward legislative ban. Illinois has taken the opposite approach, relying on enforcement rather than new statute: the state issued 65 cease-and-desist letters to sweepstakes operators in May 2026 alone. Indiana, Maine, New York, Louisiana and Tennessee have also enacted laws specifically targeting the virtual-currency loophole that let platforms such as Chumba Casino and LuckyLand Slots operate without state gambling licenses.

Liability is spreading beyond the operators themselves

The pressure isn’t limited to the platforms named on the app. Recent and pending state measures increasingly reach into the commercial ecosystem that supports sweepstakes platforms, including payment processors, geolocation vendors and media affiliates that promote the sites, extending legal exposure well beyond the operator’s own corporate entity. That shift mirrors how regulators have handled unlicensed sports betting and offshore casino promotion in the past: cut off the supporting infrastructure rather than chase the operator alone.

More states are still weighing action

At least eight additional states, including Florida, Texas, Ohio, Georgia, Virginia, North Carolina and Arizona, have active bills or regulatory task forces examining sweepstakes casino operations as of mid-2026. Given the pace of the last twelve months, operators still running in those states should expect either a legislative ban or an enforcement letter before the end of the year.

What it means for licensed iGaming operators

For licensed iGaming operators watching from the sidelines, the crackdown is being read two ways: as validation that regulators will eventually close unlicensed workarounds to real-money gaming, and as a preview of the compliance bar any operator entering a newly regulated vertical, from sweepstakes to prediction markets, should expect to eventually clear. Several operators that built sweepstakes products as a low-friction way to test US market demand are now facing the same choice Underdog and Kalshi made earlier in prediction markets: get a real license stack, or exit the market.
